Terms of Use
In short
- Whiff is for people aged 18 and over.
- Your tasting history is what the app is made of, so we keep it, as the privacy policy explains.
- Pro is a subscription through Apple. You cancel with Apple, and it runs until the end of your period.
- Malo is an AI. Its answers help you taste, but they can be wrong.
- You can delete your account at any time, right in the app.
What Whiff is
Whiff is an app that teaches you to taste wine. You answer questions about what you see, smell and taste, then find out how close you got. The app keeps your answers and scores, because that’s what you learn from. Without that history there’d be nothing to look back on.
You get the app itself through the App Store, under Apple’s standard license, the EULA. These terms cover what Whiff adds on top: your account, your data, Pro and Malo. Apple isn’t a party to these terms.
We may change the app, add to it or stop part of it. If that affects something you paid for, we’ll tell you in advance.
Who it’s for
Whiff is about wine, so it’s for adults. You must be 18 or older, which you confirm when you start. Whiff is there to help you taste better, not to drink more. How much you drink is your call.
Your account
The first time you taste, the app creates an anonymous account with no name or email address. What the app records and why is in the privacy policy.
You can delete your account at any time in the app, under Profile and then Settings. Everything goes, except what the privacy policy lists as staying.
Pro
Pro is a subscription you take out in the app and Apple bills for us. You’ll see the price and the length of a period in the app before you buy. It renews automatically until you cancel.
You cancel with Apple: in the app under Settings and then Manage subscription, or in your iPhone’s settings. When you cancel, you keep Pro until the end of the period you’ve already paid for. Do it at least a day before it renews, or Apple will still charge you for the next period.
You can get the free trial month once per device. Before it turns into a paid subscription, the app reminds you. Cancel during the trial and you pay nothing.
If you live in the EU or the UK, you can withdraw from a purchase within 14 days. That goes through Apple, like any other refund request: reportaproblem.apple.com. Apple decides on refunds.
You can always restore a purchase, for example on a new phone: in the app under Settings and then Restore purchases.
Malo
Malo is the guide inside the app, and Malo is an AI. It knows the catalog and your tastings, and helps you with what you smell and taste. But an AI can be wrong, even when it sounds sure, which is why every answer says it comes from an AI.
Treat what Malo says as help with tasting, not as fact to rely on. Malo doesn’t give medical, legal or other professional advice. If something’s off, report it; that’s how we improve.
What we tell you about a bottle
What the app says about a wine comes from public sources, the label and our own work. We do our best to get it right, but sometimes we won’t. If you spot a mistake, report it on the bottle.
A bottle may list shops that sell it. These are shops where we found it ourselves, not an overview of the whole market. Nobody pays for a place on that list, and we earn nothing if you buy something. The order says nothing about price or quality.
What you write
What you write about a wine stays yours. You let us store it and use it as far as the app needs to, for instance so Malo knows your own words.
A photo of a label stays yours too. You give us a license to read it, store it and use it to improve label recognition. That license is non-exclusive and free of charge, and it lasts as long as we keep the photo or the crop as the privacy policy describes.
Use the app the way it’s meant to be used. Don’t try to get around its security, don’t scrape data with a program, don’t harass anyone and don’t write anything hateful, discriminatory or illegal. If you do, we may block your account. We’ll tell you first, unless that’s not reasonably possible.
What’s ours
The app is ours: the design, the drawings, the writing, the questions, the code and the name. We use other people’s software and data under their licenses, listed in the acknowledgements.
What we stand behind
We do our best to keep Whiff working well, but we can’t promise the app will always be free of errors or available.
If something goes wrong because of us, we’re liable for direct damage up to what you paid Whiff in the twelve months before. We’re not liable for indirect damage. These limits don’t apply to intent or gross negligence on our part, to personal injury, or wherever the law doesn’t allow them.
When these terms change
If something important changes, you’ll see it in the app before it takes effect. If you don’t agree, you can stop and delete your account. The version and the date of the last update are always at the top.
Which law applies
These terms are governed by Dutch law. If you live in another country, you keep the protection your local law gives you as a consumer. Disputes go to the court that has jurisdiction under the law.
